Par définition, « agréé » signifie être reconnu par une autorité pour posséder des qualités requises pour une activité. L’agrément délivré par l’Etat autorise par exemple l’exercice d’une activité principalement réservée aux autorités.
Un certain nombre d’activités est réglementé ou soumis à l’obtention d’une autorisation de l’Etat. Les conditions d’accès à ces activités réglementées sont déterminées par la loi. L’obligation d’être agréé par l’Etat concerne par exemple les secteurs concernant les taxis ou VTC, les auto-écoles, les contrôles techniques, les services à la personne, etc.
L’obtention d’un agrément pour une activité peut également dépendre de la profession exercée par le demandeur. L’immatriculation des véhicules fait depuis 2009 parties de ces activités réglementées qui sont seulement accessibles à un secteur d’activité défini. En effet, il est obligatoire d’être professionnel de l’automobile pour demander l’agrément du Ministère de l’Intérieur. Après signature d’une convention, le professionnel agréé obtient l’accès au Système d’Immatriculation des Véhicules, logiciel auparavant utilisé par les préfectures. Un professionnel de l’automobile agréé par le Ministère de l’Intérieur a donc l’autorisation de l’Etat de traiter les demandes de carte grise des automobilistes. Le traitement des immatriculations doit se faire dans le strict respect des conditions fixées par la convention pour ne pas mettre en péril l’agrément.
